Tenant Damage March 2019

Situation:

  • My Tenants were evicted with Cause, and served with carefully-prepared paperwork Feb 26th.
  • They now have appeared to have abandoned the house.
  • The "Good" Roommate moved out a month ago. She came back to take and send me the pics (below) March 26th.
  • They owe for past rent, utilities, extensive-severe damage, etc. The house is filled with 3-4 dumpsters worth of garbage inside, and one in the driveway.
    I have recieved two quotes. $3000 & $3800 for trash alone.
  • They filled out a Condition Inspection Report on Move in. And roommate swaps were Added to the paperwork over time.
  • Roommates Names: Gareth, Mel (couple in North Room), Logan (South Front Room), Naomi (Middle Room)
  • I must be very careful with what I do next, as I do NOT want to have to be out $8,000-12,000.
  • I don't want to / won't access the suite earlier then told by the Tenancy Bureau. I will wait for them to advise I can throw out the garbage. My worry is they will say
    • "We were coming back to clean"
    • "You threw out my stuff"
    • "My Roommate made the mess/damage".
  • It took 3 days of sorting+Boxing just to get into each room. Cleaning hasn't even begun

  • I have NOT gone into the suite yet, but can tell from the outside the nightmare is much worse then expected.

The Good News:

I need some small-glimmer of hope from crying.

  • After 6 months of considering evicting them, the nightmare can't get any worse.
  • During my cleanup, I found Social Insurance Numbers, current / past employers and previous / forwarding / family addresses.
  • I carefully prepared all my paperwork, both on move-in, roommate swaps, and Eviction, in case this ended up in court.
  • There Condition Inspection Report (Prior to move in) says everything is in Good Condition. Except: 4 chips in the floor, a small 2" crack in a window, a bald patch on the lawn.
  • There are many roommates to go after for Damages.
  • There is one Roommate on my-side who will help me however needed.

Deep Clean:

Walls, base boards windows, window ledges, garbage removal, painting walls, replacing some floors that have been damaged, replace washer, fridge stove Carpet cleaning Blinds need to be replaced.

Painting

Wash walls, prime walls, cut walls, fill holes, paint walls
This price doesn't include: replacement of a washer, fridge, stove, floors or blinds.
Hourly labor charge 35 x $60.00 == $2,100.00

Deep Cleaning 40 x $50.00 == $2,000.00

I seen the pictures before people moved in and its going to take a lot of work and time to get this house back to the standards it was before.

To Do:

  • Contact Tenancy Bureau
  • Contact Lawyer
  • Figure out Quotes for:
    • Carpet Cleaning (if salvagable at all)
    • Replacing Hardwood floor (Condition Inspection indicates "4 small chips, painted over")
    • Painting
    • Extensive Cleaning
    • Two Dumpsters
    • Can the Tenancy people to send over an "Order of Possession"
    • When any mail arrives addressed to them, I write "Moved" on the mail, and put it in the mailbox

Questions:

  1. Most Important: How do I make CERTAIN I have my best-chance at collecting restitution?
  2. File an "Intent to Enter" Letter on the door, giving 24 hours Notice??
  3. What witness should I get to look at the current condition?
  4. How Do I make sure I actually COLLECT any money the Tenancy bureau awards?
  5. I assume I shouldn't post anything about them online?
  6. When can I assume this property is abandoned?
  7. When can I access the house? Does the Rotting Food, Open Windows with Heat Cranked, or Unpaid Bills help accelerate it? Complaint from city about garbage piled on road. Can I get Emergency Access?
  8. Two of the Tenants have taken off to Alberta Apparently. How do I go after them there?
  9. What letter should I send to all tenants?
  10. What letter should I send to the one good tenant, sho doesn't want to be held responsible for the Damage? (Draft written Below)
  11. They accidentally left some valuable stuff behind, that I know they will want back. How do I use that as an excuse to serve them with Papers?
  12. What about the Illegal SubLetter? There is someone living in there illegally?
  13. Should I turn off the power? The Heat is on full blast, and the windows are open.
  14. Do I offer the "good roommate" an exemption / money off what is owed, if she helps clean / paint / repair?
  15. Andrea Morrison: Where did you get a dumpster from? How Much?
  16. Should I ask her to do a Condition Inspection move out form with me tomorrow?
